MedsFound is run by SimplifiiSolutions Limited, a company registered in England and Wales ("we", "us"). These terms are between us and the pharmacy business that registers on the MedsFound pharmacy portal ("you", "your pharmacy").
If you accept these terms for a pharmacy, you confirm that you are authorised to do so on its behalf.
You accept these terms by ticking the box in the pharmacy portal. When you do, we record the name and role of the person who accepted, the version of the terms, and the date and time. We then email a copy to the address on your account.
You agree that accepting electronically binds your pharmacy in the same way as a signature on paper.
These terms, together with your plan (section 9), make up the agreement between us. If your pharmacy group has signed a separate written agreement with us, that agreement covers pricing and billing for your branch, and it takes priority wherever the two differ.
MedsFound is a technology service. It lets patients send a request for a medication and lets nearby pharmacies say they can help. We are a technology intermediary only. We do not:
Every dispensing decision, clinical judgement and supply of medication is the responsibility of your pharmacy and its registered staff.
You confirm that your pharmacy is registered with the General Pharmaceutical Council (or the equivalent regulator where you operate), holds every licence it needs to dispense medication, and will keep them in place for as long as you use MedsFound.
You will tell us straight away if any registration or licence is suspended, withdrawn or under investigation.
We check your registration before we switch your account on, but that check does not move any regulatory responsibility to us.
Controlled drugs are strictly regulated, including under the Misuse of Drugs Act 1971 and the regulations made under it. MedsFound flags requests for controlled drugs and holds back the patient's reference until you have spoken to them. You remain fully responsible for checking prescriptions, carrying out any consultation and following every rule that applies before you supply a controlled drug.
Patients can tell us whether they have any allergies, and we pass that on with the request. This is self reported and is not a clinical allergy check. You are responsible for allergy screening and every other safety check before you supply anything, and we are not liable for allergic reactions or other harm caused by medication your pharmacy supplies.
Requests show the medication, its strength, form and amount, and roughly how far away the patient is. They do not include the patient's name or contact details.
Your price, any free trial and the number of locations covered are set out in your plan, which you can see at any time under Your plan in the portal. You accept your plan separately in the portal, and we record that acceptance in the same way as these terms.
Free trial. You pay nothing during a free trial. We will remind you in the portal and by email at least 7 days before it ends. If you do not want to continue, choose Leave MedsFound in the portal at any time before the trial ends. Your access then stops when the trial ends and you owe nothing. If you do not leave, your paid plan starts on the day the trial ends.
Payment. Your plan is charged monthly in advance, starting on the day your paid plan starts and then on the same date each month. We will send you an invoice showing how to pay. Prices do not include VAT. If VAT applies, it will be added and shown on your invoice.
Late payment. If a payment is more than 14 days late, we may pause your access until it is paid. Pausing access does not cancel anything you already owe. We may also claim interest and compensation on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.
Direct Debit. If we offer Direct Debit and you set one up, your payments will be collected that way, and you will be protected by the Direct Debit Guarantee.
We may change the price of your plan, for example if the number of requests your pharmacy accepts moves you into a different band. We will give you at least 30 days' notice in the portal and by email before a higher price starts.
You can accept the new price in the portal, or leave before it starts and pay nothing more. If you keep using MedsFound after the change date, the new price applies.
If we lower your price, the lower price can start straight away.
You can leave at any time, with no cancellation fee, by choosing Leave MedsFound under Your plan in the portal or by emailing us.
Anything you already owe stays payable.
We may pause or end your access straight away if you seriously break these terms, lose a registration or licence, are subject to regulatory action, or do not pay. We may also end this agreement for any reason by giving you 30 days' notice.
MedsFound is provided as it is. We work hard to keep it running, but we cannot promise it will always be available or free of faults.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
We may update these terms. We will tell you in the portal at least 30 days before a significant change starts, and ask you to accept the new version when you next log in. If you do not agree with a change, you can leave before it starts.
We may give you notices through the portal or by email to the address on your account. Notices in the portal count as written notice. You can contact us at support@simplifiisolution.co.uk.
Get in touch and we will talk you through anything.
